Terms of Use
These Terms of Use (hereinafter referred to as the "Terms") apply to the relationship between the provider of nightwalk (hereinafter referred to as the "Operator") and all users of Nightwalk (hereinafter referred to as the "Service"). By using the Service, you ("User") are deemed to have agreed to these Terms.
1. Scope
- These Terms apply to all activities within the Service.
- Guidelines or other rules (hereinafter referred to as "Individual Rules") presented by the Operator on the Service or through other means are deemed to be part of these Terms. In the event of any conflict between these Terms and the Individual Rules, the Individual Rules shall take precedence.
- If you do not agree to these Terms, please refrain from using the Service.
2. Account Registration
- Users may be required to register an account to use certain features of the Service.
- When registering, Users must provide accurate and up-to-date information, and must not provide inaccurate or false information.
- If a User is a minor, the User must obtain consent from a parent or legal guardian before using the Service.
3. Service Content
- The Service is provided in a beta version and may contain functional or stability issues.
- The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Operator makes no guarantees regarding the accuracy, completeness, usefulness, or continuity of the Service.
- The Operator may change, suspend, or discontinue all or part of the Service without notice and shall bear no responsibility whatsoever for any damages incurred by the User as a result.
4. Prohibited Actions
In using the Service, Users must not engage in any of the following actions:
- Actions in violation of laws, regulations, or public order and morals
- Criminal or illegal acts, or any acts that encourage such acts
- Actions that cause or may cause disadvantage or damage to the Operator, other Users, or third parties
- Actions that infringe on the rights of other Users or third parties (including intellectual property rights, portrait rights, reputation, etc.)
- Impersonating other Users or third parties
- Uploading, transmitting, or distributing computer viruses, malware, or other harmful software
- Placing excessive load on the Service’s servers or networks, or any actions that may interfere with the operation of the Service
- Actions that violate these Terms or the Individual Rules set by the Operator
- Any other actions deemed inappropriate by the Operator
5. User-Generated Content
- All rights to the text, images, videos, and other content (hereinafter referred to as "User Content") posted or uploaded by the User to the Service shall remain with the User or the rightful owner of such content.
- Users shall ensure that their User Content does not infringe on the rights of third parties. In the event of any dispute or claim from third parties regarding User Content, the User shall resolve it at their own responsibility and expense and shall not cause inconvenience or damage to the Operator.
- The Operator has no obligation to monitor User Content. However, if the Operator deems that the User Content is illegal or violates these Terms, the Operator may delete the content or suspend the User's account without prior notice.
- The Operator may use User Content free of charge and on a non-exclusive basis for the purpose of operating, improving, or promoting the Service, including reproduction, modification, adaptation, and public display.
6. Disclaimer and Liability
- The Operator makes no warranties of any kind regarding the Service. Even if the Service is temporarily suspended, modified, or discontinued, the Operator shall not be liable for any damages incurred by the User.
- Except in cases of willful misconduct or gross negligence by the Operator, the Operator shall bear no liability for any damages (including direct, indirect, special, or incidental damages) arising from the User’s use or inability to use the Service.
- Even if the Operator is found liable for damages, the Operator's liability shall be limited to the direct and ordinary damages actually incurred.
- If a third party makes a claim or demand against the Operator as a result of the User's actions or User Content, the User shall, at its own expense and responsibility, resolve the claim and indemnify the Operator for any damages incurred (including attorney’s fees).
7. Changes to these Terms
- The Operator may modify these Terms at any time without prior notice.
- If the User continues to use the Service after such changes are made, the User shall be deemed to have agreed to the revised Terms.
